These general terms and conditions of sale (hereafter “T&C“) as well as the relevant “Privacy Policy” and “Cookies Policy” are applicable to the internet site www.LlewellynIllustration.com (hereinafter the “Marketplace“) that Llewellyn Illustrations as manager of the Llewellyn Illustrations Official Site makes available to internet users, offering the products and services manufactured and distributed under the trademarks owned and/or licensed to or by Del Llewellyn (hereafter all together the “Product(s)” and/or the “Service(s)“).
Llewellyn Illustrations is domiciled in the UK
By accessing and using the Marketplace, ordering or buying Products or Services from the Marketplace, the customer (hereafter “Customer” or “you”) declares to have fully read and understand and fully accepts all the terms and conditions included in these T&C. These T&C can be saved and/or printed and are accessible from all the pages of the Marketplace.
These T&Cs may be amended from time to time. The T&C applicable are those accepted by the Customer when placing an order, which will be sent to the Customer together with the order confirmation email once and if such order is accepted pursuant to this T&C.
The website and processor only sells products to individuals who purchase using a valid credit card and are at least 18 years of age.
Llewellyn Illustrations reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at its discretion. If we cancel an order, it will be without charge to you.
2. OUR CONTRACT
When you place an order to purchase a product from the Marketplace and processor (subject to the Terms and Conditions of Use), we will send you an email confirming you a receipt containing order details. Your order represents an offer to us to purchase a product, which is accepted when we send an email to you confirming we have accepted the order (the ‘order confirmation email’). Such confirmation or acceptance will be complete when we send the order confirmation email to you. You are seeking to enter a contract with Llewelyn Illustrations when you place an order.
This contract is legally binding when you have placed an order.
Llewellyn Illustrations will retain the title of the products until full payment has been made by you and has been received by Llewellyn Illustrations. Llewellyn Illustrations reserves the right to hold any orders prior to shipping for security review. Llewellyn Illustrations only delivers its products to the UK mainland unless agreeing to deliver worldwide by agreement and assuming shipping costs are met by the customer. If an order is placed for a delivery to a location where we do not deliver, the order will be cancelled, and a refund processed.
3. DELIVERIES
We will endeavour to deliver all products ordered within the time period specified on the website. Normally 10 -15 working days, some delivery times may vary. Costs for delivery are shown in the check out function.
All products purchased from the website are made pursuant to a shipment contract. This means that the risk of loss for such products passes to you on delivery to the carrier. If you have received your order confirmation email but your products have not arrived within the time specified, please contact us and we will do our best to assist. Please allow an additional day before raising a query during exceptionally busy periods (e.g. Christmas and other holidays etc.) or when the weather is particularly inclement.
If your order has not been received within the specified timescales set out below, in the first instance please check whether your local mail delivery office is holding your parcel. If they do not have your products, please contact us and we will do our best to assist.

4. RETURNS
All products at the website are offered as made-to-order/customisable items v. As such, all sales are deemed to be final and refunds will not be issued with the exception of those instances indicated in our Refund Policy.
We will pay the return costs and subsequent re-delivery costs (if applicable) if an approved return is a result of our error or the goods are faulty.
This returns procedure does not affect your statutory right to cancel or any of your other statutory rights.
5. Conditions for All Returns
We request that you take reasonable care of the goods when opening our packages. All goods approved for return and must be returned to us unused, in suitable packaging to ensure the goods will not be damaged in transit, together with all original product packaging (please note you have a duty to take reasonable care of returned goods and any refund may be withheld or a charge incurred if you fail to take such care and damage the goods). Please make sure that your return package is packed and sealed securely. We will arrange for collection and assume freight charges related to all approved returns as per our Exchanges and Return policy.
6. Return Address
As we sometimes ship from multiple locations, a return address will be provided to you by a customer service agent.
7. Discrepancies
If there are any discrepancies with your order, you must notify us within 48 hours. If you have been shipped the incorrect goods, then please accept our apologies. Please contact our customer service team and we will arrange a collection of these goods. Any replacements will be sent at no extra cost.
8. Refunds
For refunds, please note that the refund will not show in your bank account until at least 3 days after the refund had been made. If it is not there after this time, please check with your bank before contacting customer services.
9. FEEDBACK AND COMPLAINTS POLICY
We welcome any comments about our Service, so we can improve it. Our aim is to deal with any problems quickly and fairly. If you wish to complain, please email our customer services team stating clearly that you are making a complaint. Our aim is to respond within seven (7) working days, either resolving the complaint, or with a timescale for resolution.
10. CUSTOMS
When ordering products from the website for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you as we have no control over them and cannot predict what they may be. Customs policies vary widely by country, so you should contact the local customs office for further information. Additionally, please note that when ordering from the website, you are considered the importer of record and must comply with all laws and regulations of the country in which the products are received. Your privacy is important and we know you care about how order information is used and shared. International Customers and Customers shipping products internationally should be aware that cross-border deliveries can be opened and inspected by customs authorities.
11. DISCLAIMER AND LIMITATION OF LIABILITY
11.1FROM INFORMATION
The Customer accepts that Llewellyn Illustrations assumes no responsibility for the delay, deletion, erroneous delivery and/or failure to store Customer communications.
Llewellyn Illustrations does not assume liability for decisions taken based on the information provided on the Marketplace nor any of the damages to the Customer or third parties arising from actions that are based exclusively on the information obtained from the Marketplace.
11.2 FROM QUALITY OF SERVICE
We reserve the right to refuse to provide the service for anyone for any reason and/or discontinue the service or any part thereof, with or without prior notice.
Use of this Marketplace is subject to all applicable regulations and the Customer is solely responsible for the method of communications they use to access the Marketplace. Access to the Marketplace does not imply any obligation on the part of Llewellyn Illustrations to control the absence of viruses, worms or any other malicious software. The Customer is responsible in all cases for having adequate tools for detecting and disinfecting malicious software. Llewellyn Illustrations is not liable for any damage to the operating systems, software, hardware or any other equipment of Customers or of third parties leveraged during the accessing of the Marketplace service.
Llewellyn Illustrations does not give any guarantees and is in no case liable for damages or detriment of any kind arising from access to or the use of the content on the Marketplace. Among others, including and not limited to, Llewellyn Illustrations will not be held responsible for the following circumstances:
- The absence of maintenance and effective operation of the Marketplace and/or of its services or content;
- Lack of usefulness and functionality of the Marketplace;
- The existence of viruses, malicious or harmful programs.
- The receiving, obtaining, storing, spreading, or transmitting of contents by Customers.
- The illicit, negligent, or fraudulent use, contrary to the General Terms, or to good faith, of the generally accepted uses, or of the public order, of the Marketplace and its contents, by the Customer.
11.3 FROM THE AVAILABILITY OF THE SERVICE
Access to the Marketplace requires services and supplies from third parties, including transmission through telecommunications networks, the reliability, quality, continuity, and functionality of which are not the responsibility of Llewellyn Illustrations. Accordingly, services provided through the Marketplace may be suspended, cancelled, or blocked, prior or simultaneous to the provision of the Marketplace service.
Llewellyn Illustrations is not responsible for damages of any kind incurred by the Customer that are caused by failures or disconnections in telecommunications networks, computer failures or other electronic systems that cause the suspension, cancellation, or interruption of the Marketplace service during a customer’s session.
11.4 ON THE CONTENT AND SERVICES LINKED THROUGH THE MARKETPLACE
The Marketplace access service includes technical linking devices, directories and even search tools that permit the Customer to access other websites and internet portals (hereinafter, ‘Linked Sites’). The Marketplace includes Linked Sites solely as a convenience to Customers. In such cases, Llewellyn Illustrations acts as an intermediation service provider in conformity with Article 17 of Information Society Services and Electronic Commerce Law 34/2002, of July 12, 2002 (the “LSSI”) and will only be liable for the content and services supplied on Linked Sites to the extent that Llewellyn Illustrations is actually aware of their unlawfulness and has not disabled the link with due care.
Under no circumstances must the existence of Linked Sites presuppose the existence of agreements with the owners or persons in charge of those Linked Sites, or any recommendation, promotion, or identification of Llewellyn Illustrations with, the representations, content or services provided. The Linked Sites are provided solely for reference purposes as a convenience to Customers. Although Llewellyn Illustrations only provides links to websites that, to the best of its knowledge and belief, comply with applicable law, Llewellyn Illustrations is not aware and does not approve of the content or services of Linked Sites and, therefore, cannot be held liable for any damage caused by the unlawfulness, quality, obsoleteness, unavailability, error or ineffectuality of the content and/or services of Linked Sites, or for any other damage that is not directly attributable to Llewelyn Illustrations.
Llewellyn Illustrations makes no express or implied warranties with regard to the information, material, products, or services that are contained on or accessible through the Linked Sites. Access and use of the Linked Sites, including information, material, products, and services on linked sites or available through linked sites, is solely at the Customer’s own risk. explicitly disclaims any responsibility for the accuracy, content, or availability of information found on sites that link to or from the Marketplace from third parties. Because some sites employ automated search results or otherwise link you to sites containing information that may be deemed inappropriate or offensive, Llewellyn Illustrations cannot be held responsible for the accuracy, copyright compliance, legality, or decency of material contained in third-party sites.
Llewellyn Illustrations cannot ensure that you will be satisfied with any products or services that you purchase from a third-party site that links to or from the Marketplace, since other shop channels are owned and operated by independent retailers. Llewellyn Illustrations does not endorse any of the merchandise on these third-party sites. Llewellyn Illustrations does not make any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third party, and you agree to irrevocably waive any claim against us with respect to such sites. You, the Customer, hereby irrevocably waive any claim against Llewellyn Illustrations with respect to any claim arising out of any Linked Sites.
We reserve the right to remove or block access to this content suspected of being illicit or detrimental to assets or rights of third parties and including cases in which we have effective knowledge of this, whether through court decision, administrative order, or any other means.
12. ELECTRONIC COMMUNICATIONS
When you visit the website or send emails to us, you are communicating with us electronically. We will communicate with you by email or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
13. DISPUTES
Any dispute relating to your visit to the website or to products you purchase through the website may be submitted to the courts of England, except that, to the extent you have in any manner violated or threatened to violate Llewellyn Illustrations, intellectual property rights, Llewellyn Illustrations may seek injunctive or other appropriate relief in any court in any country in the world, and you consent to exclusive jurisdiction of such courts.
14. ALTERATION OF SERVICE OR AMENDMENTS TO THE CONDITIONS
We reserve the right to make changes to our website, policies, and T&C at any time. Your use of the website and your orders will be subject to the policies and terms and conditions of sale in force at the time that you use the website or that you order products, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of the provisions of these T&C are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of the remaining conditions.
15. FORCE MAJEURE
Llewellyn Illustration will not liable or responsible for the failure or delay to perform any of its obligations caused as the result of an event of force majeure, outside of Llewellyn Illustrations control that could not reasonably foresee at the time when the contract was entered into with the Customer and which consequences Llewellyn Illustrations cannot reasonably avoid or overcome.
16. STATUTORY WARRANTIES. CONFORMITY AND HIDDEN DEFECTS
Llewellyn Illustrations is bound by the statutory warranties relating to conformity and defects in the Product. Llewellyn Illustrations shall deliver a product that conforms to the contract (including but not limited to the Product itself, non-conformities resulting from packaging, assembly instructions or installation when responsible for it) and will be liable for any non-conformities existing upon delivery
When acting on the ground of the statutory warranty of conformity, the Customer:
- can choose between repair or replacement of the Product, unless either of these two options is objectively impossible or disproportionate: and
Llewellyn Illustrations shall only be liable for the Products, i.e., Products purchased at the online Marketplace.
It should be noted that statutory and commercial guarantees do not cover damage or defects resulting from an external cause (accident, knock, etc.) or from the Customer’s misuse or use different from the Products’ description.

18. WAIVER
If you breach these T&C and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
19. GOVERNING LAW AND JURISDICTION
These T&C are governed in each of its points by English law for the resolution of any controversy related to the present T&C, or the Marketplace. By accessing the Marketplace, each User agrees that any action at law or in equity, arising out of or relating to these T&C, shall be filed only in English courts, and each Customer hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these T&C shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these T&C and shall not affect the validity and enforceability of any remaining provisions. The failure of Llewellyn Illustrations to exercise or enforce any right or provision of these T&C shall not constitute a waiver of such, or any other, right or provision. This is the entire agreement between us relating to the subject matter herein and shall not be modified except in writing, signed by both parties.
